Should I plead guilty or not guilty to a criminal offence?
The question of guilt is not always as straightforward as it first seems. The defendant must seek specialist legal advice to understand what the elements of the offence against them are. If the prosecution cannot prove every element of the offence to the criminal standard then the defendant is not guilty of the offence. The defendant should always seek legal advice before making a decision on plea.
