Quentin secures acquittal in kidnap case and secures wasted costs against the CPS

Quentin represented Mr BG before Kingston Crown Court. BG together with 3 others stood accused of kidnap and assault occasioning actual bodily harm in respect of an incident involving the alleged abduction of a drug user. Although the alleged kidnap was caught on CCTV the prosecution had a number of problems with their case and Quentin had made an earlier application to dismiss the charges. On the first day of trial Quentin made representations to the CPS in respect of the continuance of the case and following a day of negotiations the prosecution agreed to offer no evidence on all charges against BG. Not guilty verdicts were therefore entered and Mr BG walked out of Court with no convictions.

 

Following the verdict Quentin made an application for wasted costs against the prosecution in respect of CPS disclosure failings in advance of the trial. This application was heard and Her Honour Judge Kent granted Quentin’s application for wasted costs in the full sum applied for.
