Quentin successfully defends Limited Company in driving case

It is well known that Limited Companies bear many of the same legal rights and responsibilities as individuals and can be labile under the criminal law in the same way as individuals.

It is however unusual for a limited company to be the defendant in a driving case, for obvious reasons.

However, Quentin Hunt found himself representing TL ltd, a large limited company with 3,500 employees which was accused of the offence of failure to provide driver’s details under s172 of the Road Traffic Act 1988. The company was accused of failing to provide the details of a driver of a van which was caught speeding on the A13 in Essex. The company had done all that it could to comply with the terms of the notice however the crucial driving logs had been destroyed or taken by the employee responsible for the speeding who did not wish to be identified.

The matter came before the Southend on Sea Magistrates Court and following Quentin’s representation of the Company a Not Guilty verdict was entered by the Court in very swift time.
