Client avoids jail in Death by Dangerous Driving case

Quentin’s client avoids jail in Death by Dangerous Driving case

Quentin represented Miss SR who was charged with death by dangerous driving contrary to section 1 of the Road Traffic Act 1988. The charge was brought following an accident on an A Road in Wales on Christmas day. Unfortunately, SR fell asleep behind the wheel of her motor vehicle and collided with a gentleman who was changing the wheel of a stranded motor vehicle. Tragically, the gentleman died of the injuries that he sustained.

SR came to Criminal Barrister Quentin Hunt on a Direct Public Access basis for advice and assistance in her case.

The prime aim for the client in this tragic case was to avoid going to prison and Quentin immediately started working towards that aim on behalf of his client. SR pleaded guilty at an early stage in order to gain maximum credit towards sentence and Quentin put together an impressive mitigation package on her behalf.

At Court Quentin entered a plea in mitigation on her behalf to the sentencing judge that was designed to attempt to avoid an immediate custodial sentence. Any sentence other than immediate custody is very rare in such cases

At the end of the sentencing hearing the judge agreed with Quentin’s submission and handed down a suspended sentence of imprisonment. Quentin’s client was obviously delighted with the result.

The case received substantial press coverage and can be read about here.

Some cases cannot be won and involve a damage limitation exercise on behalf of the client. Such cases require great skill and tactical nuance in presenting the facts in a way that best advantage the client and ensure that the best possible result is achieved.
